I'm not sure about your first quote (the only google results were for this comment), but the second one was a demonstration of a feature that was not and is not available!
OK, so what you said is wrong, since the Elon quote is:

So he explicitly explains that you have to monitor it, and does not bury it in the fine print as you claim. Hardly a smoking gun, even if you really are contorting yourself to find something objectionable in this quite.
